From January 1 next year, there will be three regulations on the disclosure, submission and disclosure of information in the power industry. They are the "Measures for the Disclosure of Electricity Regulatory Information", the "Regulations on the Information Reporting of Power Enterprises" and the "Regulations on Information Disclosure of Power Enterprises". These regulations will play a major role in strengthening power regulation and maintaining order in the power market.

It is reported that these three measures were adopted on November 9th by the eighth meeting of the Chairman of the State Electricity Regulatory Commission. Recently, it was announced in the form of Decree No. 12, Decree No. 13 and No. 14 of the Electricity Regulatory Commission. It will be implemented on January 1, 2006.

It is understood that the information referred to in the "Measures for the Disclosure of Electricity Regulatory Information" refers to documents, data, charts, etc. produced, obtained or owned by the SERC and its dispatched institutions in the course of fulfilling their duties of power supervision. Information disclosure methods include the SERC portal website and its sub-sites, newspapers, radio, television and other media, press conferences, compilation of policies and regulations, and other ways to obtain information. In addition, major power regulatory information will be released to the public in a timely manner through a spokesperson.

The Regulations on Information Reporting of Power Enterprises is mainly to strengthen power supervision, regulate the information reporting behavior of power companies and power dispatching trading institutions, and maintain the order of the power market. Enterprises engaged in power generation, transmission, and power supply services respectively submit corresponding information, and power dispatching and trading institutions should also submit relevant information.

The Regulations on Information Disclosure of Power Enterprises regulates the disclosure of information on power construction, production, operation, price and service by power companies and power dispatching trading institutions, and specifies the disclosure content, disclosure methods and supervision and management.

The latter two provisions are clear. If the provision of false information or conceal of important facts and failure to disclose relevant information or disclose false information as required, the power regulatory agency shall order it to make corrections; if it refuses to make corrections, it shall impose a fine of not less than 50,000 yuan but not more than 500,000 yuan. The directly responsible person in charge and other directly responsible personnel shall be punished according to law; if a crime is constituted, criminal responsibility shall be investigated according to law.
